1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and infoBlizz ("Company," "we," "us," or "our"), a technology company registered in India. These Terms govern your access to and use of our websites, applications, AI-powered tools, SaaS platforms, APIs, and all related products and services (collectively, the "Services").

By accessing, browsing, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use our Services.

2. Definitions

For the purposes of these Terms:

• "Services" means all websites, platforms, applications, APIs, tools, features, and content operated by infoBlizz, including but not limited to infoblizz.com, Celebsthreads.com, ProDevTools.com, DevCalculators.com, and any AI-powered or SaaS products offered by the Company.
• "User Content" means any data, text, code, files, images, feedback, or other materials that you submit, upload, transmit, or otherwise make available through the Services.
• "AI Features" means any artificial intelligence, machine learning, natural language processing, or automated decision-making capabilities integrated into our Services.
• "Subscription" means a recurring paid plan that grants you access to premium features, enhanced functionality, or additional resources within our Services.
• "Intellectual Property" means all patents, trademarks, service marks, trade names, copyrights, trade secrets, proprietary algorithms, source code, designs, logos, and all other intellectual property rights associated with the Services.

3. Eligibility

You must meet the following requirements to use our Services:

• You must be at least 18 years of age, or the age of legal majority in your jurisdiction, whichever is higher;
• You must have the legal capacity to enter into a binding agreement;
• You must not have been previously suspended or removed from our Services;
• Your use of the Services must not violate any applicable law or regulation in your jurisdiction.

If you are under 18 years of age, you may only use our Services under the supervision and with the consent of a parent or legal guardian who agrees to be bound by these Terms.

4. Account Registration and Security

Certain features of our Services may require you to create an account. When registering, you agree to:

• Provide accurate, current, and complete information during registration;
• Maintain and promptly update your account information to keep it accurate and complete;
• Maintain the confidentiality of your account credentials (username and password);
• Accept responsibility for all activities that occur under your account;
• Notify us immediately at media@infoblizz.com if you suspect any unauthorized use of your account or any security breach.

We reserve the right to suspend or terminate your account if any information provided during registration proves to be inaccurate, outdated, or incomplete, or if we reasonably believe your account has been compromised.

5. Description of Services

infoBlizz is a technology company that builds and operates AI-powered tools, SaaS platforms, and digital products. Our current portfolio of Services includes:

• Celebsthreads.com: A fashion e-commerce marketplace connecting consumers with fast fashion products and curated collections.
• ProDevTools.com: A suite of professional developer tools and SaaS products designed for software engineers, developers, and technical teams.
• DevCalculators.com: A comprehensive collection of technical calculators and computation tools for developers, engineers, and professionals.
• AI-Powered Products: Various artificial intelligence-driven tools, features, and services integrated across our platforms and offered as standalone products.

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Services.

6. License and Access

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use our Services for your personal or internal business purposes. This license does not include:

• Any resale or commercial redistribution of the Services or their contents;
• Any collection or use of product listings, descriptions, prices, or other content for purposes unrelated to your authorized use;
• Any derivative use of the Services or their contents;
• Any downloading, copying, or reproduction of account information for the benefit of a third party;
• Any use of data mining, robots, scraping, or similar data gathering or extraction tools;
• Any use of the Services beyond the scope expressly permitted in these Terms.

This license is automatically revoked if you violate any of these Terms. We reserve all rights not expressly granted to you.

7. Acceptable Use Policy

You agree not to use the Services to:

• Violate any applicable local, state, national, or international law or regulation;
• Infringe upon or violate the intellectual property rights, privacy rights, or other rights of any third party;
• Upload, transmit, or distribute any malicious code, viruses, worms, Trojan horses, or other harmful or destructive content;
• Attempt to gain unauthorized access to our systems, servers, networks, or other users' accounts;
• Interfere with or disrupt the integrity or performance of the Services or the data contained therein;
• Engage in any activity that imposes an unreasonable or disproportionately large load on our infrastructure;
• Use the Services to send unsolicited communications, spam, or promotional materials;
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity;
• Use our AI features to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable;
• Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, algorithms, or underlying technology of our Services;
• Use automated means (including bots, scrapers, or crawlers) to access, scrape, or extract data from our Services without our prior written consent;
• Circumvent, disable, or interfere with any security features of the Services.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account and access to the Services, without prior notice or liability.

8. AI and SaaS-Specific Terms

The following additional terms apply to your use of our AI-powered features and SaaS products:

a) AI-Generated Outputs

• Outputs generated by our AI features are provided on an "as is" basis. While we strive for accuracy and quality, AI-generated content may contain errors, inaccuracies, or biases.
• You are solely responsible for reviewing, verifying, and validating any AI-generated output before relying on it for any purpose, including but not limited to business decisions, code deployment, content publication, or professional advice.
• We do not guarantee that AI-generated outputs will be unique, original, or free from intellectual property concerns.

b) SaaS Service Levels

• We endeavor to maintain reasonable uptime for our SaaS products but do not guarantee uninterrupted or error-free service.
• Scheduled maintenance windows may result in temporary service unavailability. We will make reasonable efforts to provide advance notice of planned maintenance.
• We are not liable for any downtime, data loss, or service interruptions caused by factors beyond our reasonable control, including but not limited to internet outages, third-party service failures, or force majeure events.

c) API Usage

• If we provide APIs as part of our Services, your use of such APIs is subject to any additional API documentation, rate limits, and usage policies we may publish.
• We reserve the right to throttle, restrict, or revoke API access at our discretion if we detect misuse, abuse, or usage that exceeds fair use limits.

d) Data Processing

• When you use our SaaS products, you retain ownership of the data you submit. We process your data solely to provide and improve the Services as described in our Privacy Policy.
• We may use aggregated, anonymized data derived from your usage for analytics, benchmarking, and product improvement purposes.
• For enterprise or business accounts, additional data processing terms may apply as specified in a separate Data Processing Agreement (DPA).

9. Intellectual Property Rights

All content, features, functionality, software, designs, text, graphics, logos, icons, images, audio, video, data compilations, and the overall arrangement thereof available through the Services are owned by infoBlizz, its licensors, or other providers of such material and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The infoBlizz name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of infoBlizz. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on our Services are the trademarks of their respective owners.

Nothing in these Terms shall be construed as transferring any intellectual property rights from infoBlizz to you, except for the limited license expressly granted in Section 6.

10. User Content

You retain ownership of any User Content you submit through our Services. However, by submitting User Content, you grant infoBlizz a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform such User Content solely in connection with operating, providing, improving, and promoting the Services.

You represent and warrant that:

• You own or have the necessary rights, licenses, and permissions to submit the User Content and to grant the rights described herein;
• Your User Content does not violate any applicable law, regulation, or the rights of any third party;
• Your User Content does not contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.

We reserve the right (but are not obligated) to review, monitor, edit, or remove any User Content at our sole discretion, for any reason, including violation of these Terms.

11. Payment and Subscriptions

a) Pricing and Billing

• Certain Services or features may require payment of fees. All fees are quoted in Indian Rupees (INR) or such other currency as specified at the point of purchase, and are exclusive of applicable taxes unless stated otherwise.
• We reserve the right to change our pricing at any time. Price changes for existing subscriptions will take effect at the start of the next billing cycle following notice to you.

b) Subscriptions

• Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
• You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of the current billing period.

c) Refunds

• All fees are non-refundable unless otherwise stated in writing or required by applicable law.
• If you believe you have been charged in error, please contact us at media@infoblizz.com within 7 days of the charge.

12. Third-Party Services and Links

Our Services may contain links to or integrations with third-party websites, applications, or services that are not owned or controlled by infoBlizz. We are not responsible for the content, privacy policies, practices, or availability of any third-party services.

Your interactions with third-party services, including payment processors, analytics providers, and AI service providers, are governed solely by the terms and policies of those third parties. We encourage you to read the terms and privacy policies of any third-party services you access through our platform. The inclusion of any third-party link or integration does not imply endorsement or affiliation by infoBlizz.

13. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, INFOBLIZZ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
• WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR INFORMATION PROVIDED THROUGH THE SERVICES, INCLUDING AI-GENERATED OUTPUTS;
• WARRANTIES THAT DEFECTS WILL BE CORRECTED OR THAT THE SERVICES OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

You expressly agree that your use of the Services is at your sole risk. No advice or information, whether oral or written, obtained by you from infoBlizz or through the Services shall create any warranty not expressly stated herein.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL INFOBLIZZ, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, business opportunity, or other intangible losses;
• Any damages arising from your use of or inability to use the Services;
• Any damages arising from unauthorized access to or alteration of your transmissions or data;
• Any damages arising from statements or conduct of any third party on the Services;
• Any damages arising from reliance on AI-generated outputs, recommendations, or automated decisions;
• Any other matter relating to the Services.

In no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms or the Services exceed the greater of (a) the amount you have paid to infoBlizz in the twelve (12) months preceding the event giving rise to the claim, or (b) One Thousand Indian Rupees (INR 1,000). This limitation applies regardless of the form of action, whether in contract, tort, negligence, strict liability, or otherwise.

15. Indemnification

You agree to indemnify, defend, and hold harmless infoBlizz, its directors, officers, employees, agents, partners, licensors, and affiliates from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the Services; (b) your violation of these Terms; (c) your violation of any applicable law, regulation, or third-party right; (d) any User Content you submit or make available through the Services; or (e) your negligence or willful misconduct.

16. Termination

We may terminate or suspend your access to the Services, in whole or in part, immediately and without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms;
• Violation of the Acceptable Use Policy;
• Request by law enforcement or government agencies;
• Discontinuance or material modification of the Services;
• Unexpected technical or security issues;
• Extended periods of inactivity;
• Non-payment of applicable fees.

You may terminate your account at any time by contacting us at media@infoblizz.com or through your account settings.

Upon termination, your right to use the Services will immediately cease. Sections of these Terms that by their nature should survive termination shall continue in full force and effect, including but not limited to Sections 9 (Intellectual Property), 13 (Disclaimer), 14 (Limitation of Liability), 15 (Indemnification), and 18 (Governing Law).

17. Modifications to Terms and Services

We reserve the right to modify these Terms at any time at our sole discretion. When we make material changes, we will:

• Update the "Last Updated" date at the top of these Terms;
• Provide notice through our Services or via email (where required by applicable law);
• Give you a reasonable period to review the changes before they take effect.

Your continued use of the Services after the effective date of any modifications constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue your use of the Services.

18. Governing Law and Dispute Resolution

a) Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. All matters relating to the Services and these Terms, and any dispute or claim arising therefrom or related thereto, shall be governed by the laws of India.

b) Jurisdiction

You irrevocably agree that the courts located in New Delhi, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the Services.

c) Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the parties shall first attempt to resolve the dispute through good-faith negotiations. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may initiate arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The seat and venue of arbitration shall be New Delhi, India. The arbitration shall be conducted in English by a sole arbitrator mutually appointed by the parties. The arbitrator's decision shall be final and binding on both parties.

19. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms. The remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.

20. Waiver

The failure of infoBlizz to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of infoBlizz.

21. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices, agreements, or policies published by us on the Services, constitute the entire agreement between you and infoBlizz regarding your use of the Services. These Terms supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.
